LANSING -- The Michigan Court of Appeals on Friday reversed part of a $315,000 award given to a woman whose fall during a service led to a falling-out with her former church and pastor.

In her civil lawsuit filed in July 2005, Judith Dadd of Lansing claimed that during a rally at Mount Hope Church in Eaton County’s Delta Township in July 2002, she went to the altar and was “overcome by the Spirit of the Lord.”


She said she fell backward and struck her head on the floor, and that the church was negligent because no usher was there to catch her. She also said the pastor, David R. Williams, damaged her reputation by suggesting she faked the injury and might be trying to commit insurance fraud.

In its ruling, the three-member court said Dadd was entitled to the $40,000 awarded for negligence but ruled that the remaining claims for false light, libel and slander must be considered at a new trial.


The judges said the lower court judge erred in not properly instructing the jury that Williams may have had a “qualified privilege” to discuss Dadd with certain members of his congregation.


They reversed the nearly $274,000 the jury awarded Dadd for false light, libel and slander and sent the case back for a new trial on those issues.

Dadd, who was a member of the church for 12 years, claimed in her lawsuit that she still suffers from the effects of the fall, including symptoms of depression, memory loss and difficulty concentrating.


Court of Appeals judges in the case were Joel Hoekstra, E. Thomas Fitzgerald and Brian Zahra.

I want to have a field day with this one but I will be respectful lol....as best I can with my limited humanity.:lachen: Maybe they should also have a "pillow of the L-rd" for those places where there are not enough hands to catch those falling out?

I just do not comprehend "falling out for the L-rd." What is the purpose or benefit of it? I know that people often fake this spiritual experience...as many fake speaking in tongues. I believe that it is largely suggestion and has roots in West African spirituality. Perhaps some have a truly g-dly spiritual experience...but in my experience in which I attended services with friends, I smelled a rat. How can I say? There are some that "suggest" that a person will have such an experience....when it is truly fake.

Imagine, "G-d, I'm angry there was no holy pillow beneath my head, nor angel's hands easing me downward while I was knocked out in your Spirit and hit my head hard." Imagine the expression on Jesus' face..."Do you honestly believe I knocked you out and told you to fall down, my daughter?":nono:

I'm gonna be blunt with it:

when you are TRULY IN THE HOLY SPIRIT, you WILL NOT HURT YOURSELF dancing out your clothes (like David) or falling out under the power of the Holy Ghost or speaking in tongues FOR REAL (like in the Upper Room)....I wouldn't be able to stand under all that raw power of the Holy Ghost, either....

Ummm...now that I think about it. If she's blaming elders for not being there to catch her, how come she isn't "suing the Holy Spirit or the angels?" The absurdity of the whole thing is along the lines of the people who sue God. *smh*

That's clarification. Thank you. Obviously, she was knocked out by her greed. And I hope the judge socks it to her...forgive the pun :lachen:
